Terms and Conditions of Sale

1. Interpretations
"Customer" means the purchaser of goods from the Company.
"Goods" means all the Goods sold and/or delivered by Innov.Net Pty Ltd to the Customer.

2. Application
These Terms apply to all contracts for the sale of Goods by Innov.Net Pty Ltd.

3. Quotations
(a) Innov.Net Pty Ltd will generate quotations to a customer when a request is received via email or telephone.
(b) The quotation is valid for 30 days.
(c) A customer is required to inform Inno.Net Pty Ltd via email should the customer wishes to proceed with the quotation.

4. Prices
Prices are determined at the time of order.

5. Payment method
(a) Payments are to be made to Innov.Net Pty Ltd without any deduction or discount other than as stated in these Terms or in the relevant invoice or statement.
(b) Payment must be made in full prior to our dispatchment of the Goods.
(c) Payment method is Direct Debit.

6. Goods delivery
(a) We provide drop ship and delivery to the specified address.
(b) It is the responsibility of the customer to correctly state the postal address, whether by email, post or courier. Innov.Net Pty Ltd cannot be held responsible for any damaged, missing or delayed orders where incorrect or incomplete delivery details (address and, if relevant, appropriate delivery instructions) have been provided.
(c) Delivery via Standard Post
Australia
Standard Post delivery is via Australia Post. Innov.Net Pty Ltd accepts no responsibility for any damage, loss or delay as a result of using Australia Post's service. If for any reason your Goods doesn't arrive, please contact us immediately.

New Zealand
Standard Post delivery is via New Zealand Post. Innov.Net Pty Ltd accepts no responsibility for any damage, loss or delay as a result of using New Zealand Post's service. If for any reason your Goods doesn't arrive, please contact us immediately.

7. Guarantees and warranties required by law
(a) RM Pro and RM Mini 3 supplied by Innov.Net Pty Ltd comes with 15 months warranty commencing from the date of purchase. For Smart light switches and double GPO that is supplied by Innov.Net Pty Ltd it is 12 months warranty from the date of purchase.
(b) Customer must use the product according to the user guide.
(c) On discovery of any defect in the Goods, the Customer must immediately notify Innov.Net Pty Ltd in writing of such defect. The Customer must not carry out any remedial work to the alleged defective Goods without first obtaining the written consent of Innov.Net Pty Ltd to do so.
(d) Innov.Net Pty Ltd complies with both Australian and New Zealand Consumer Law in respect of guarantees and warranties for our products and services. In respect of products, it is our responsibility to ensure the products are of acceptable quality, free from defects and fit for the purpose considering the prices and description provided to you at the point of sale.

8. Exclusions
Innov.Net Pty Ltd expressly excludes all warranties with respect to damage:
(a) caused or arising out of improper installation, modification, alteration or repair;
(b) unusual or excessive wear and tear;
(c) caused by vandalism or other criminal acts;
(d) resulting from wilful acts, misuse or neglect by the Customer, its servants, agents or third parties;
(e) caused by use of the Goods outside the purpose for which the Goods are supplied as set out in:
(i) these terms and conditions;
(ii) any specification or Goods instructions published from time to time by Innov.Net Pty Ltd; or
(iii) any specification of any standards organisation which has certified the Goods comply with such specification

9. Limited and liability
Innov.Net Pty Ltd is not subject to, and the Customer releases Innov.Net Pty Ltd from, any liability (including but not limited to consequential loss or damage) because of any delay in delivery or fault or defect in the Goods or damage caused by installation by others. The Customer acknowledges that Innov.Net Pty Ltd, in any event, is not liable for:
(a) lost of business profit or sales.
(b) mobile devices lost of data, changes of the format and malfunctions.
(c) special, indirect, consequential, incidental, exemplary or punitive damages however caused and regardless of the theory of liability, arising out of the use of or inability to use the product or in any way connected to this agreement, even if Innov.Net Pty Ltd has been advised of such damages.
(d) business interruption cost.
(e) the cost of electrician(s) incurred by customers to fix the problem of the smart light switches, GPO, 2way switches, dimmer switch, TV outlet, Data and Telephone outlet that were purchased from Innov.Net Pty Ltd.
The foregoing limitation of liability applies whether a claim is based upon principles of contract, warranty, negligence or other tort, breach of any statutory duty, principles of indemnity or contribution, or otherwise.
In no event will Innov.Net Pty Ltd’s liability to Customer exceed the purchase price paid for the product that is the basis for the claim.

10. Force Majeure
Innov.Net Pty Ltd is not liable for any breach of contract due to any matter or thing beyond the Innov.Net Pty Ltd's control (including but not limited to transport stoppages, transport breakdown, fire, flood, water spillage, earthquake, acts of God, strikes, lock-outs, work stoppages, wars, riots or civil commotion, intervention or public authority, explosion or accident).

11. The Customer's cancellation
Unless otherwise agreed in writing, the Customer may not cancel an order which has been accepted by Innov.Net Pty Ltd.

12. Damaged goods
Upon the goods arrived and is damaged, the customer should take a photo and email a brief details of the damage goods to innov.net_enquiries@yahoo.com. Innov.Net Pty Ltd will issue a RMA number to the customer. Customer is required to attach the RMA number and post it together with the damaged goods. Innov.Net Pty Ltd will replace a new unit to the customer after the inspection. Customer is responsible for the postage of returning the damage goods.

13. Defects goods
When encounter a defects from the goods, customer is encourage to check the Support's FAQ for solutions prior submitting the problem to innov.net_enquiries@yahoo.com. All genuine defects will be issued with RMA number by Innov.Net Pty Ltd. Customer should post the defect goods together with the RMA number to Innov.Net Pty Ltd on 26, Kootingal St. Greystanes. NSW 2145.
